General terms and conditions of sale
Valid from 01 January 2021.
Bivouac nature does its utmost to ensure that its commercial documents, and in particular the prospectuses, advertisements, catalogs, are as faithful as possible to the services offered. However, it is possible that the customer’s perception of the photographic representation of the services does not exactly correspond to the services themselves. Their vocation is therefore essentially informative.
The description, the definition of the seasons, the minimum rental periods as well as the periods, the rental periods appear on the Bivouac nature website: www.bivouac-nature.com
The prices can be viewed on our booking area by entering the desired dates of stay. The rental price includes the rental of the accommodation or the pitch, the number of people (depending on capacity), charges (water, gas, electricity), a vehicle, access to reception services and activities offered on the bivouac.
The customer can make his reservation request via the online reservation space on the website: www.bivouac-nature.com
Bivouac nature draws the customer’s attention to the fact that whatever the channel chosen, the reservation becomes effective only after sending the written confirmation of the reservation by Bivouac nature by email (and on request by post), after receipt of the amount due for the deposit, and any administrative fees and any subscription fees for cancellation insurance. This written reservation confirmation contains the details of the reservation made by the customer as well as all the information relating to his stay. The reservation of a stay therefore becomes effective only with the agreement of Bivouac nature, after confirmation by our services and either after receipt of the contract duly completed and signed; or after acceptance of the General Conditions of Sale when booking online.
All reservations must be accompanied by a payment including:
- a deposit, determined according to the type of stay booked, the rate of the latter depending on and the date of reservation, between 50% and 100% of the total amount of the stay (rental only or rental with options);
- application fee ;
- any subscription fees for cancellation insurance.
For online reservations on our reservation area, payment of the deposit or the entire stay is made following validation of your reservation request by our services.
Reservations only bind Bivouac nature to its customers if Bivouac nature accepts them. Bivouac nature is free to validate or refuse a reservation request, depending on availability, and in general, any circumstances likely to affect the execution of the reservation made. Bivouac nature offers family holidays, in the traditional sense. The accommodations are specially designed for this purpose. Bivouac nature reserves the right to refuse any reservation which would be contrary to this principle, or which would seek to divert it.
By making an online reservation, the customer acknowledges accepting these General Conditions of Sale.
ABSENCE OF RIGHT OF WITHDRAWAL
In accordance with Article L. 221-28 12 ° of the Consumer Code, the right of withdrawal does not apply to accommodation services provided on a date or at a specified period.
PRICES AND TAXES
Prices are in euros, taxes included. Any changes to rates as well as to the taxes applied to your stay, at the date of invoicing, could affect the price of your stay.
Evolution: prices are dynamic and may change over the course of the season. Bivouac nature can in no way be held responsible for a difference in cost between two stays booked for the same period. The prices indicated are in euros, VAT included at the rate in force at the time of the reservation of the stay.
The total price of the stay includes the rental price of the rental accommodation or of the additional services chosen, the reservation costs and any cancellation insurance. This total price is indicated prior to the validation of the reservation of his stay by the customer, whether the reservation is made on the Bivouac nature website or through another reservation channel. Any change or modification of the rate as well as any change in taxes applicable to the stay, on the invoice date, may be reflected in the price of the stay.
Taxes: the tourist tax collected on behalf of the municipality is payable. It is not included in the prices displayed.
Its amount, determined per person and per day, may change during the year.
Arrival and departure times
- Rentals and pitches are available between 4 pm and 7 pm on the day of arrival.
- Rentals and pitches must be vacated before 10 am on the day of departure.
For any delayed departure, you may be billed for an additional day at the prevailing nightly rate.
Customer responsibility: it is up to the customer to ensure. The customer is responsible for the surveillance of his personal items (bicycles, etc.). Bivouac nature declines all responsibility in the event of an incident involving the civil liability of the customer.
All customers must comply with the provisions of the internal regulations. Each tenant in title is responsible for the disturbances and nuisances caused by the people who stay with him or visit him.
Location: the allocation of rental or location is made without distinction in the order in which reservations are recorded. The management can in no way guarantee that the site or the rental requested by the camper will be allocated to him.
Assignment, subletting: any rental contract is personal and non-transferable. The accommodation or the pitch may under no circumstances be transferred or sublet.
Accommodation capacity: the rental or pitch has a limited accommodation capacity. The number of people arriving for a stay may not exceed the capacity of the accommodation (see description of the rental); a baby or a child counted as a person. Any overrun without the agreement of management would result in termination of the contract without giving rise to compensation.
Parking: for any additional vehicle the customer will be liable for a parking tax (5€ per day and per vehicle).
Leisure activities: any free or paid activity mentioned in our brochure or on our website or in an email may, in certain circumstances, be modified or canceled upon your arrival on the site. As such, our responsibility cannot be engaged. Regarding the free activities and/or entertainment offered on the site, the customer will not be able to claim any compensatory compensation on the price of his stay in the event of cancellation or modification.
Prices and taxes: any change or modification of the rate as well as any change in the taxes applicable to your stay, on the invoice date, may be reflected in the price of your stay.
STAY IN RENTAL ACCOMMODATION
Services: all our accommodations are equipped according to the description on the website and on the inventory given to the customer on arrival.
Electricity is supplied by solar panels. This equipment can only provide lighting in Cabins, Canadian tents and Safari tents.
The rentals are non-smoking. Sheets, towels and tea towels are not provided in the rental.
Inventory and inventory: the accommodation must be restored to perfect condition and the inventory can be checked upon departure. Any broken or damaged object will be the responsibility of the customer, as well as the restoration of the premises if this is necessary. The deposit will be returned to you at the end of your stay after deduction of the compensation retained for any damage noted during the check-out inventory.
Housekeeping: the accommodation must be left in a perfect state of cleanliness. If at the time of departure, the person responsible for the exit inventory considers that the cleaning has not been done, a cleaning fee may be applied in addition or withheld from the deposit (at the price of the cleaning fee in force at the date of stay increased by 25%).
Security deposit: for any stay in rental accommodation, a security deposit of 400€ will be requested on arrival. Payment can be requested by check, cash or credit card imprint. The latter will be returned in full on the day of departure or at the latest within 30 days, after a satisfactory inventory of fixtures.
Otherwise, the following will be deducted from the security deposit: the value of the missing items, possibly a flat-rate cleaning fee (at the price of the cleaning fee in force on the date of the stay, increased by 25%) for facilities cleaned in a manner insufficient and the amount of repairs in the event of damage caused by the occupant.
In the event of damage greater than the amount paid as a security deposit, management may request a financial supplement up to what it deems necessary for the change or repair of damaged goods.
STAY IN A CAMPING PITCH
Bivouac nature provides the customer with bare pitches for individual tents only, which can accommodate up to 4 people. There is no electrical connection possible.
The basic package gives free access to health and reception facilities and to the activities offered free of charge on the site. For safety reasons, the number of people arriving for a stay may not exceed the capacity of the campsite.
The price of the location: this is a fixed price per night of occupancy for the type of location concerned. The basic package includes an installation for 1 or 2 people and a vehicle.
Supplement: additional people (adults or children), additional tent on the pitch or additional vehicle are subject to an additional daily cost.
Payment methods accepted: payment for your stay can be made by bank transfer.
Booking fees: 20 €
Deposit: 50% of the total amount of the stay must be paid in order to validate the reservation.
Payment of the stay: the balance of the stay must be paid, without reminder from us, 60 days before the scheduled arrival date for the rental or on the day of arrival when the client has not booked. In the absence of full payment on the agreed date, Bivouac nature is entitled to consider that the customer has canceled his reservation and keeps the sums already paid.
Duration of stay: the client signing the contract concluded for a fixed period may not under any circumstances invoke any right to remain in the premises at the end of the stay.
DELAYED OR POSTPONED ARRIVAL AND EARLY DEPARTURE
In the event of a late arrival, between 7:00 p.m. and 9:00 p.m., on the date provided for in the rental contract, the customer must notify the reception of Bivouac nature in order to keep the team informed and thus confirm their arrival. A flat rate of 50 € will then be applied. No arrival will be possible after 9 pm.
After 9 pm, if the client does not show up and there is no information message from him specifying a postponed arrival date, Bivouac nature will consider that the client cancels his stay. The accommodation will then become available immediately and full payment for the services will remain required.
In the event of an early departure in rental accommodation, no reduction will be granted (see possibilities of reimbursement under the cancellation insurance).
Weather conditions (rain, heat, etc.) cannot justify compensation. Any interruption or cancellation of stay on the grounds that the weather is not good does not give the right to any financial compensation.
MODIFICATION OF STAY
You have the possibility, during the same season, to modify the dates or the composition of your stay according to our availability. This modification must be requested at least 14 days before the start of the initial stay in writing (email or letter) to be validated.
Note: any change of dates or type of accommodation is considered to be a modification of the stay.
Modification fees: any modification request will incur a handling fee of 15€.
A stay may be postponed depending on availability and under the following conditions:
- in the event of a price higher than the initial amount, the customer will have to pay the supplement;
- in the event of a service of a lower amount, no compensatory reimbursement will be made.
- any request for an increase in the length of your stay will be made subject to availability and at the rates in force.
- any request to reduce the length of your stay is considered a partial cancellation and will be subject to the terms of cancellation and interruption of stay.
In the absence of any modification, the customer must complete his stay under the initial booking conditions or cancel it.
No postponement will be accepted for the following season.
Modification by Bivouac nature
In the event that Bivouac nature is required to modify the services initially provided for the stay, everything will be done to provide similar services; the customer may either accept the modification or terminate the contract and obtain reimbursement of the sums paid, under the conditions referred to in Article R.211-9 of the Tourism Code.
INTERRUPTION OF STAY
In the event of an interruption due to Bivouac nature, except in cases of force majeure, Bivouac nature undertakes to offer customers an equivalent stay by possibly bearing any additional price and, if the services accepted by the customer are of inferior quality, Bivouac nature will reimburse him the difference.
In a Covid-19 situation, in the event of an interrupted or shortened stay for one of the following reasons:
• border closure,
• administrative closure of the campsite,
• quarantine on arrival of the customer or on return of the customer to his country,
• limitation of travel to a number of kilometers that does not allow you to come to the campsite,
A voucher of an amount corresponding to the nights not consumed, less the cost of the cancellation insurance if it has been taken out, and valid for 18 months, will be issued by the campsite. Bivouac nature refers to the conditions issued by the Ordinance of March 25, 2020 relating to the extension of deadlines expired during the health emergency period and the adaptation of procedures during this same period.
Apart from the reasons mentioned above, any interrupted or shortened stay (late arrival, early departure, variable weather, etc.) due to the customer cannot give rise to a refund or a voucher.
In the event of interruption due to the customer, no reduction will be granted in the event of early departure (see possibilities of reimbursement under cancellation insurance).
CANCELLATION OF A STAY
In the event of cancellation due to Bivouac nature, except in cases of force majeure, in the event of cancellation before the customer’s arrival, the sums paid for the reservation will be fully refunded. This cancellation may not, however, give rise to the payment of damages.

Bivouac nature draws the customer’s attention to the fact that in the absence of cancellation under the conditions provided for in this article, the customer will be required to pay all sums due under the contract.
For any canceled stay:
• more than 60 days before the date of arrival, the deposit remains acquired by Bivouac nature
• less than 60 days before arrival or in case of no-show at Bivouac nature, the total rental amount
Regardless of the cancellation date chosen, the administrative fees and cancellation insurance that may be taken out are not refundable.
CANCELLATION AND INTERRUPTION OF STAY INSURANCE
Cancellation and interruption of stay insurance is optional but, in order to obtain any compensation, we invite the customer to take out cancellation or interruption of stay insurance when booking. Its amount is a percentage of the total amount of the stay.
Our partner Gritchen Affinity undertakes to reimburse all or part of the stay to our holidaymakers. This insurance covers in particular the cancellations of your stay in the event of illness (hospitalization), serious accident or death, claims resulting in significant damage to your home, dismissal or modification of your leave due to the employer, following the invitation to an examination. or in court. All the clauses of the cancellation insurance contract are available on request and on the website: www.campez-couvert.com
Note: a warranty extension has been added to the cancellation insurance contract. These new guarantees now cover in the event of Covid disease, quarantine following a positive Covid test or if in the event of proven contact with quarantine, upon presentation of proof.
In the event of cancellation or interruption of your stay, notify Bivouac nature of your withdrawal upon the occurrence of an event preventing departure by mail or email. If the loss is provided for in the general insurance conditions, the customer must notify the insurer within 48 hours and provide all the necessary information and supporting documents, by declaring the loss by internet: www.declare.fr, by email: firstname.lastname@example.org or by mail to: Gritchen Tolède et Associés – Sinistre Campez couvert – 27 rue Charles Durand – CS70139 – 18021 Bourges Cedex – France.
If the reason is not covered by the cancellation insurance or if the file is refused by it, the general conditions of sale apply and the cost of the cancellation insurance will be deducted from the sums paid in the event of cancellation.

In order to facilitate the course of the stay for all our customers, internal regulations are available at reception. We thank our customers for knowing it and respecting it. In the event of non-compliance with this regulation, the Management may take sanctions up to the termination of the contract.
RESPECT AND CARE
The client agrees to adopt a reasonable attitude and to be courteous to the staff of Bivouac nature. He will thus ensure that he respects the Rules of conduct established in the place of his stay.
Bivouac nature reserves the right to cancel or terminate the contract against any person who does not comply with these conditions or whose behavior would be insulting, aggressive, violent or under the influence of alcohol or drugs, without compensation or any refund.
to other campers
The customer agrees to respect all other campers on the site.
to vegetation, fauna and insects
All vegetation must be respected. The customer agrees not to cause any material damage or to the plants and trees present on the site. It is thus forbidden to pick plants, flowers, drive nails into trees, cut or pull out branches, or plant. It is also not allowed to delimit a space by personal means, nor to dig the ground.
Likewise, any harm to wildlife through the feeding of certain animals or the extermination of insects by the use of insecticides is strictly prohibited.
In the event of non-compliance with these rules and proven degradation, Bivouac nature will be entitled to request compensation.
Minors unaccompanied by their parents will not be accepted on the Bivouac nature site.
The accommodation or pitches offered on the site are intended exclusively for individual customers. Any reservation of more than 2 accommodations by the same natural person or by different natural persons but knowing each other and traveling together for the same reasons on the same dates of stay at Bivouac nature is considered as a group.

Bivouac nature reserves the right to study the reservation request before it is accepted or refused.
Pets are not accepted throughout the area.
Bivouac nature reserves the right to refuse access to the site to any person accompanied by a pet.
LOSS, THEFT, DEGRADATION
Bivouac nature draws the customer’s attention to the fact that camping and holiday village rentals do not fall under the responsibility of hoteliers provided for in articles 1952 and following of the French Civil Code.
Consequently, Bivouac nature declines all responsibility in the event of theft and damage to personal items both in rental accommodation and in common premises. Bivouac nature cannot be held responsible in the event of theft or damage to clients’ personal items, except in the event of proven failure by Bivouac nature to meet its obligations. It is also recalled that the car parks are not guarded and that parking is therefore done at the risk and peril of the customer. Bivouac nature also declines all responsibility in the event of an incident involving the civil liability of the customer.
SPECIAL OFFERS – LAST MINUTE DEALS
Promotional offers are subject to certain terms ans conditions, and notably subject to availability. Moreover, any rate reductions or promotional may not be accumulated unless otherwise indicated and may not be applied retroactively. On such occasions, some customers may have paid a different price for the same stay. The difference between the price actually paid and the special offer price will in no case be paid back to the customers who paid the higher amount.
All photos and texts used in the brochure or on the Bivouac nature website are non-contractual. They are only indicative. It may happen that certain activities and facilities offered by Bivouac nature and indicated in the description in the brochure are canceled, in particular for climatic reasons or in the event of force majeure as defined by the French courts.
The customer expressly acknowledges that Bivouac nature cannot be held responsible, due to the communication by its partners or by any third party of false information which would be mentioned in the brochure or the website of Bivouac nature concerning the presentation photos, the qualifiers, activities, hobbies, services and dates of operation.
You authorize Bivouac nature, as well as any person designated Bivouac nature, to photograph, record or film you during your stay at Bivouac nature and to use said images, sounds, videos and recordings on any media (in particular on the sites or internet pages of Bivouac nature – including Facebook and Instagram – on Bivouac nature presentation and promotion media and on travel or tourist guides). This authorization is valid both for you and for the people staying with you. Its sole purpose is to ensure the promotion and animation of Bivouac nature and may not in any way damage your reputation. This authorization is granted free of charge, for all countries and for a period of 5 years.
The information communicated during an order will not be transmitted to any third party. This information will be considered confidential. They will be used only by the internal services of Bivouac nature, for order processing and to strengthen and personalize the communication and offer of services reserved for Bivouac nature customers according to their areas of interest. Any banking data collected and processed by Bivouac nature will only be kept for the time of the completion of the payment transaction unless the customer has expressly agreed.
In accordance with article 40 of law n ° 78-17 of January 6, 1978, known as the “Informatique et Libertés” law, the customer has the right to access, modify, rectify and delete personal data concerning him. Any possible complaint concerning non-compliance of services with contractual commitments can be reported by mail to the address: Bivouac nature – Customer Relations Department – Graousse – 30270 Saint Jean du Gard – France.
For customers usually residing in a European Union State other than France, they may avail themselves of the following provisions: either the laws and jurisdictions of their State of habitual residence, or French laws and courts. In the event of a dispute or complaint, the customer should preferably contact Bivouac nature to obtain an amicable solution.
These general conditions are subject either to the application of French law or to the application of the law of the place of habitual residence for customers residing within the European Union. This is the case for the substantive rules as for the rules of form.
In the context of a dispute, you have the option of contacting Bivouac nature as follows:
• sending a letter by registered letter with acknowledgment of receipt to the manager;
• sending a copy of this letter to customer service at firstname.lastname@example.org or by mail to: Bivouac nature – Customer Relations Department – Graousse – 30270 Saint Jean du Gard – France.
After a period of one month following the sending of these letters or emails and in the absence of a response deemed satisfactory, by the customer or by Bivouac nature, to a complaint formulated under the conditions mentioned above, the most diligent part submit the dispute to Medicys, a mediation body initiated by the National Chamber of Judicial Officers in France. In the event that mediation fails, the client and Bivouac Nature may refer the matter to the competent French court, ie the court of the place of usual residence for clients usually residing in a European Union state other than France.
These general terms and conditions are governed either by French law or by the legislation in the usual place of residence of clients for those clients residing in the European Union. This is applicable for rules of substance and of form.
The rental of accommodation implies full acceptance of the conditions of sale by the contracting parties. As such, the customer declares to have read these general conditions of sale before validating his rental.
In addition, by accepting these general conditions of sale, the customer is aware that his stay takes place in the heart of nature, with the hazards that it can present: variable weather, presence of wildlife and insects nearby accommodation and that it is also possible to cross it indoors.
